Discharging Planning Conditions

Read your decision notice, identify pre-commencement requirements and assemble the evidence needed before starting the relevant work.

Planning permission is often the beginning of a compliance process, not its end. Conditions can control materials, drainage, landscaping, construction methods and how a development is occupied. Starting at the wrong stage can create avoidable planning risk.

01

Turn the decision into a tracker

Read every condition alongside the approved drawings, obligations and informatives. Record the exact trigger, the evidence required, who will prepare it and the approval or implementation deadline.

Distinguish a condition requiring approval of details from one requiring construction in a particular way. Some need a formal application; others need careful compliance with the stated terms. Do not assume all conditions can be cleared with one generic letter.

02

Pre-commencement means before the relevant start

A pre-commencement condition can require approval before development or a specified operation begins. The exact wording matters. Agree the lawful sequence before instructing demolition, excavation or other enabling works.

If a condition is unclear or unworkable, obtain planning advice about clarification, variation or another available remedy. Do not assume the builder can start while the paperwork catches up.

03

Submit a coordinated evidence package

Materials may need product details and samples; drainage may need calculations and layouts; construction management may need logistics, hours, vehicle arrangements and neighbour protection. Give each document a clear revision and link it to the relevant condition.

Check the council's approval-of-details application procedure and fee. A complete submission reduces requests for missing information, but validation is not approval and the authority's target period is not a guaranteed clearance date.

04

Do not confuse discharge with changing permission

Approval of details should not be used to introduce a materially different design. Changes to the consented scheme may require a non-material amendment, a section 73 application where available, or a fresh permission.

The appropriate route depends on the proposed change and the wording of the permission. Obtain advice before ordering a substitute material or moving an opening that the planning drawings fix.

05

Close out and retain the record

Keep written approvals with the final drawings and make sure the contractor builds the approved details. Pre-occupation and ongoing conditions can remain relevant after the structure is finished.

At handover, provide the owner with the condition tracker, decisions and outstanding maintenance or use restrictions. A planning condition approval is separate from building control completion and any contractual practical-completion certificate.

Checklist

Points to confirm before you commit time or money.

  1. Extract every condition and its precise trigger.
  2. Assign evidence, responsibility and lead time.
  3. Obtain required written approvals before the relevant work.
